Traffic Offenders Program

A Traffic Offenders Program (also called a Traffic Offender Intervention Program or TOIP) is a road safety education course designed for people who have pleaded guilty to, or been found guilty of, a traffic offence in NSW. Magistrates can order you to attend a program before sentencing, or you can choose to complete it voluntarily to show the Court you are taking steps to improve.

What the Program Is

The Traffic Offenders Program teaches safe driving behaviour and helps participants think about how their choices affect themselves and others on the road. 

It’s not meant to punish people — it’s designed to help you:

  • Understand road rules and responsibilities

  • Recognise risky driving behaviours

  • Think about the impact of offending on victims and the community

  • Learn strategies for safer driving in the future 

Who Can Do It

You can participate in a Traffic Offenders Program if:

  • You have been referred by the Court after a guilty plea or conviction

  • Your lawyer suggests you attend

  • You decide you want to complete it voluntarily before your court date 

Approved programs are available across NSW and typically involve a small fee. 

How the Program Works

Most Traffic Offenders Programs cover topics such as:

  • Why people offend on the road

  • The dangers of speeding, drink driving and distraction

  • Real stories about the effects of crashes

  • How decisions affect you and others

  • Tips for safer driving in daily life 

You can usually complete the program:

  • In person at a local classroom

  • Online at your own pace

  • Via virtual classroom (Zoom) with a facilitator 

Programs are interactive and educational — not punitive.

What You Receive When You Finish

After completing the program, you receive a certificate of completion or a court report. This document can then be provided to:

  • The Local Court

  • Your lawyer

  • The Magistrate or Judge considering your sentence 

This shows the Court that you have taken positive steps to improve your driving.

Does Completing the Program Reduce Your Penalty?

Completing a Traffic Offenders Program does not automatically guarantee a lighter penalty in court — only the Magistrate can decide that. 

However, attendance is often considered a mitigating factor, especially when combined with:

  • A genuine guilty plea

  • Evidence of behaviour change

  • A strong legal submission from your lawyer

Courts may view completion positively as part of your overall mitigation.
